INTRODUCTION & CLIENT BACKGROUND

Our client, a married gentleman in his 60s who has purchased four homes and sold three over the past 37 years, was buying a second-hand house in Co. Cork.

The client was purchasing this property as an investment while retaining the family home in Dublin.

This was the client’s first time using an online property solicitor. He was referred to us by his broker.

Having dealt only with traditional solicitors before, using an online service was new to him. The client was unsure what to expect but was impressed by the efficiency, clarity, and affordability of our online service.

INSTRUCTION: We were instructed by the client to handle the legal transaction for the purchase of an investment property.

ONBOARDING: Once the client was onboarded, we created a client portal profile, verified their identity and address, and assigned a case manager to support the client while the solicitor handled the legal aspects of the purchase.

REVIEW OF SALES ADVISE NOTICE AN AND LOAN APPROVAL: We reviewed the Sales Advice Notice and the client’s loan approval to ensure there were no onerous conditions.

RECEVING CONTRACTS: We received and reviewed the contracts and title to the property, raising pre-contract enquiries. A minor building regulation breach (landing height) was identified, and we advised the client in writing.

VACANT POSSESION PROTECTION: As the property was still occupied when the sale was agreed, we acted in our client’s best interests by ensuring the contract included clear terms regarding vacant possession.

We added a special clause requiring the property to be empty and free from tenants or other occupants at completion.

This meant that if the property was not vacated by the agreed date, our client could walk away from the purchase and recover their deposit.

CONTRACTS EXCHANGE, SIGNING, CLOSING DATE: Once the contract was in order, we arranged for the client to sign it, agreed a tentative closing date with the vendor, and received the signed contracts. We then returned the contracts to the vendor’s solicitors and submitted the loan documents to the lender for drawdown.

FINAL INSPECTION, FINAL SEARCHES AND COMPLETION: After the client’s final inspection confirmed everything was in order, we completed the final searches and transferred the funds to complete the purchase.

KEYS RECEIVED: Once we received the closing documents, the client received the keys.

COMPLETION: Although the client’s part was complete, we still have post-completion steps: stamping the deed, registering him with the PRA, notifying him once registration is complete, returning the title deeds to the lender, and closing the file.

Notwithstanding the fact that this was a complex property transaction, the purchase was completed within 14 weeks.
